Terms of Service

1. Acceptance of these terms

By creating a ForestVPN account, installing one of our apps, or otherwise using the ForestVPN service (the "Service"), you agree to these Terms of Service (the "Terms"). If you do not agree, do not use the Service. If you use the Service on behalf of an organization, you represent that you are authorized to accept these Terms on its behalf.

2. The Service

ForestVPN provides a virtual private network and related privacy tooling that encrypts your network traffic and routes it through our servers, operated as a no-logs service (see our Privacy Policy). ForestVPN is also a white-label platform: in addition to our own consumer VPN app, we power VPN products that other businesses ("tenants") offer under their own brands. If you reached the Service through a tenant's branded product, that tenant may apply its own additional terms to your use of its product; these Terms govern the underlying ForestVPN Service. We continuously improve the Service and may add, change, or remove features over time. We aim to give reasonable notice of material changes that reduce core functionality.

3. Your account

You are responsible for the activity that happens under your account and for keeping your credentials secure. You must provide accurate information when you register and keep it up to date. Notify us promptly if you believe your account has been compromised. You must be old enough to form a binding contract in your jurisdiction to use the Service.

4. Acceptable use

You agree not to use the Service to:

  • break any applicable law or regulation, or facilitate someone else doing so;
  • send spam, malware, or otherwise abuse, attack, or overload any network or system, including ours;
  • infringe the intellectual-property or privacy rights of others;
  • attempt to probe, scan, or test the vulnerability of our systems without our written permission, or to bypass any access controls; or
  • resell, sublicense, or share access to the Service except as expressly permitted by your plan.

We may suspend or terminate access that we reasonably believe violates this section or puts the Service or other users at risk.

5. Subscriptions, billing, and renewals

Paid plans are billed in advance on a recurring basis (for example monthly or annually) through our payment providers — currently Stripe and CloudPayments for web/direct purchases, and the Apple App Store and Google Play for in-app purchases on mobile. Where you purchase through Apple or Google, that store's terms also govern the transaction, including its rules for cancellation and refunds. Unless you cancel before the end of the current term, your subscription renews automatically at the then-current price. You can cancel at any time; cancellation takes effect at the end of the current billing period. Some plans meter usage (such as data transferred); metered charges are calculated from the aggregate counters described in our Privacy Policy. Except where required by law or by the applicable app store's policy, fees already paid are non-refundable. Taxes may apply depending on your location.

6. Trials and promotions

We may offer free trials or promotional pricing. Unless we say otherwise, a trial converts to a paid subscription at the end of the trial period unless you cancel first. We may modify or withdraw promotions at any time.

7. Termination

You may stop using the Service and close your account at any time. We may suspend or terminate your access if you materially breach these Terms, if required by law, or if continuing to provide the Service to you would create a security or legal risk. On termination, your right to use the Service ends, though sections that by their nature should survive (such as payment obligations, disclaimers, and limitations of liability) will continue to apply.

8. Disclaimers

The Service is provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all warranties, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure against every threat.

9. Limitation of liability

To the maximum extent permitted by law, ForestVPN and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising from or related to your use of the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us for the Service in the twelve months before the event giving rise to the claim.

10. Changes to these terms

We may update these Terms from time to time. When we make material changes, we will update the version and effective date shown at the top of this page and, where appropriate, notify you. Your continued use of the Service after changes take effect means you accept the updated Terms.

11. Governing law

These Terms are governed by the laws of the jurisdiction in which ForestVPN's operating entity is established, without regard to conflict-of-laws principles. The specific governing law, venue, and dispute-resolution process will be confirmed by counsel before launch.
